Terms of Service
Welcome to Feferiti Lux Loft + Patio. By booking an event at our venue located at 7511 Main Street, STE 300, Frisco, TX 75034 you (“Client” or “Renter”) agree to the following Terms of Service, which constitute a binding agreement between you and Feferiti Lux Loft + Patio, LLC (“Venue” or “Owner”).
1. Use of Venue
The Venue is to be used only for the agreed-upon event type, date, and time. Entry is granted at the Rental Start Time, and full vacate must occur by the Rental End Time. Early entry and late exit are not permitted without prior written approval. Music must end 45 minutes before exit time.
2. Payments & Deposits
A $1,000 non-refundable deposit is required to reserve your event date. Payment is accepted via cash, check, or Zelle. Please include your event date in the memo for Zelle. A $500 refundable security deposit is due two weeks before the event via Zelle or cash only. Failure to adhere to the payment schedule will result in event cancellation and forfeiture of all prior payments. Final rental balance must be paid by the due date stated on the invoice. Bookings made within 30 days of the event must be paid in full at signing.
3. Security Deposit Policy
The $500 security deposit is subject to deductions for: Overtime usage Damages or missing property Improper cleanup (see Section 22: Exit Policy)Violation of any terms. Additional costs beyond the deposit amount must be paid by the Renter within 3 days of notice.
4. Overtime Policy
A $250/hour fee (or fraction thereof) applies for use beyond your scheduled rental time. Any overtime usage will be deducted from the security deposit. If the deposit is insufficient to cover the fee, the remaining balance is due within 3 days of invoice receipt.
5. Decorations & Damage Policy
Prohibited materials include: glitter, confetti, silly string, rice, staple guns, duct/masking/packing tape. Only painter’s tape is allowed. Wall damage, adhesive residue, or abandoned items may result in fines or deposit forfeiture.
6. Fire, Smoking & Cooking
No open flames or indoor smoking allowed. Sternos and chafing dishes are permitted. Candles, incense, or any other flames are prohibited. Smoking is strictly prohibited anywhere on the premises.
7. Rescheduling & Cancellation
All payments are non-refundable. One (1) reschedule is permitted with: At least 45 calendar days’ notice A $250 rescheduling fee New date scheduled within 6 months of the original Government mandates (e.g. pandemic-related restrictions) allow penalty-free rescheduling, but no refunds.
8. Capacity
The event cannot exceed 250 people. The Renter assumes full responsibility for any fines or violations related to capacity.
9. Alcohol Policy
Alcohol may only be served to guests 21+.All alcohol must be consumed indoors. The Renter is responsible for ensuring guests do not drink and drive. Alcohol sales are not permitted unless licensed.
10. Legal Compliance
Renter must: Comply with local, state and federal laws Obtain necessary permits/licenses if required Assume
responsibility for any legal violations during the event.
11. Liability & Indemnification
Renter agrees to indemnify and hold harmless Itz A Vibe Event Venue and its staff from any injury, loss, damage, or legal liability caused by the Renter, guests, or vendors during the event.
12. Force Majeure
The Venue is not liable for cancellations due to events beyond its control, including:
Natural disasters Government restrictions Power outages Pandemics Payments will be held as credit toward a future date within 12 months.
13. Vendors & Deliveries
All vendors must be insured and vacate the venue by the end of the rental time. The Venue is not responsible for any vendor property or deliveries made on behalf of the Renter.
14. Equipment & Venue Property
Venue equipment is not to be used unless express permission is granted. Damaged or missing equipment will be charged to the Renter.
15. Prohibited Conduct
Any threatening behavior, illegal drug use, weapons, or violence will result in immediate event termination and full payment forfeiture. The Renter is liable for all consequences, including legal action.
16. Cleanup Responsibilities (Exit Policy)
At the end of the event: Tables must be cleared Major spills must be cleaned Food debris and liquids must be cleared from counters and containers Trash must be tied in black bags and disposed of in designated areas Bathrooms must be free of clogs or debris A walk-through with the Event Manager is required before final exit. Failure to meet these conditions may result in forfeiture of the security deposit.
17. Insurance
The Renter is encouraged to obtain event liability insurance. If required, proof of insurance must be submitted prior to the event.
18. Entry Rights
Venue staff may enter the space at any time for safety, maintenance, or operational reasons.
19. Agreement Revocation
The Venue reserves the right to cancel the event and retain all payments if: Any terms of this agreement are violatedPayments are not made on time Safety or public order is at risk
20. Legal Disputes & Fees
All disputes shall be resolved in the local courts of Orange County, NY. The Renter agrees to pay any legal or collection costs incurred due to contract breaches, including a minimum of $400 or 20% of the unpaid balance, plus court fees.
21. Identity Verification
A valid government-issued ID is required to complete the booking.
22. Media Release
The Renter grants permission to use photos or videos from the event for promotional purposes with no compensation required.
23. Entire Agreement & Amendments
This document constitutes the entire agreement between parties. Any amendments must be in writing and signed by both parties.
